Alabama’s Stance on CBD Hemp Oil Legal Updated Due to Farm Bill

Just days after the 2018 Farm Bill was passed by Congress, Alabama’s Attorney General, Steve Marshall, updated his office’s stance on the legal status of Cannabidiol. Triggered by a provision in the omnibus bill that legalizes industrial hemp, Marshall’s office confirmed that it also made CBD hemp oil legal.

CBD Hemp Oil Legalized in Alabama

Cannabidiol derived from hemp and with no more than 0.3% THC is now legal to grow, sell, and possess in Alabama.CBD is one of more than 100 chemicals in all variations of the cannabis sativa plant and can be derived from hemp or marijuana. The updated notice by Marshall’s office only makes CBD hemp oil legal while CBD derived from marijuana (cannabis plants with more than 0.3% THC) is still illegal.

The update is a boon for the state’s economy as well as the many victims of Alabama’s notorious war on cannabis.

Alabama’s previous approach to CBD oil for sale

Earlier in the year, the Attorney General’s office issued another public notice, which outlined guidelines on how 2014 and 2016 laws impacted the state’s approach to cannabidiol.

Carly’s Law established protections from prosecution for people with debilitating epileptic conditions. who’ve received a prescription for CBD authorized by the University of Alabama at Birmingham’s Department of Neurology. Carly’s Law passed by the AL legislature in 2014 and expires in July 2019.

Leni’s Law provides a similar line of defense for CBD possession for those being treated with debilitating or chronic conditions that result in seizures. For both Carly’s Law and Leni’s Law to provide protection to patients, the CBD must contain less thatn 0.3% THC. In October of 2018, the state’s Department of Public Health also authorized the medical use of FDA-approved drug Epidiolex, to treat Lennox-Gastaut syndrome and Dravet syndrome—two severe forms of epilepsy.

Implementation of the changes won’t happen overnight however. Once the Farm Bill legalizes industrial hemp, it will not be legal to grow or process hemp-derived CBD products immediately in Alabama as the state, USDA, and FDA establish rules and guidelines for the newly legalized hemp industry.
